Customer's Duties and Liability Waiver

You acknowledge that you have the care, custody and control of the equipment owned by Castle Creek LLC, aka Turd Ferguson's Junk Removal and Hauling, while the equipment is on your property. Therefore, you agree to indemnify and hold harmless Castle Creek LLC owners, affiliates and employees from and against any and all claims for loss of or damage to property, injury or death of person or persons resulting from or arising in any manor of customers use, operation or possession of any equipment furnished in this agreement. 

You agree that Castle Creek LLC employees may drive company vehicles on your property and you accept responsibility for any and all damage that may occur from Castle Creek LLC vehicles and equipment. This includes damage to roads, culverts, fences, landscaping or other areas that the truck and/or trailer may contact while attempting to drop or pickup dumpsters. All our drivers will do their best to protect your property. Our dumpsters weigh 4,000 pounds unloaded plus the waste you will place in them, so please be aware of the possible damages that can be caused on surfaces, especially older driveways. You agree we will not be responsible for any damage.

During peak season, Castle Creek LLC, at its discretion, may sub contract dumpster services to local competitors to satisfy demand. You agree to indemnify the subcontracted roll off company to the same extent as laid out in this agreement.

Furthermore, you warrant that all waste placed in the dumpster is of non-hazardous nature and that no liquids will be placed in the dumpster. Paints, chemicals, batteries, asbestos, heavy metal electronics, refrigerants, propane tanks, medical waste, tires, liquids, roof tear offs, concrete, dirt are NOT allowed in the dumpster. 

You also agree to not fill the dumpster above the rim. Any material above the top rim of the dumpster will be taken out during pickup and left on the property. Per DOT laws, we CANNOT haul materials above the rim of the dumpster.

You agree that the dumpster can be picked up after 48 hours from the time it is dropped unless an agreement is made for a longer rental. We may pick up the dumpster after the 48 hour period. We will contact you if we will be more than 24 hours later than scheduled for pickup.

You agree that you will pay an extra tonnage charge of $70 per ton if the dumpster weight exceeds 2 tons. We will contact you to collect this additional fee and provide proof of weight through a landfill weight ticket receipt. Common items that cause an extra tonnage charge are drywall, lumber, metals, and other dense items.

By purchasing a dumpster rental through our online tool, you agree to all the above terms and indemnities.
